(a) The department shall establish a system for receiving and processing individual complaints alleging a violation of this subchapter by an insurer regardless of whether the insurer is required to file a periodic report under § 542.006.
(b) The department shall investigate an insurer if the department determines that:
(1) based on the number and type of complaints against an insurer, the insurer does not meet the minimum standard of performance adopted under § 542.007; or
(2) the number and type of complaints against the insurer are not proportionate to the number and type of complaints against other insurers writing similar lines of insurance.
