(a) The fee for “Birth or Death Certificate” under § 118.011 is for issuing a certified copy of a birth certificate or death certificate and is the same as the fee charged under Subchapter C, Chapter 191, Health and Safety Code, by the state registrar of vital statistics and the local registrar of births and deaths.
(b) A county clerk who collects a fee under this section for a certified copy of a birth certificate shall deposit the fee into the county treasury. The state’s portion of the fee shall be sent to the comptroller as provided by Subchapter B, Chapter 133.
