(a) If the commissioners court has not attempted to create a board, or if the creation of a board is declared by a court to be invalid, the commissioners court may exercise the powers and perform the duties of the board under this chapter. The commissioners court may ratify the actions taken by a board before the declaration of the board’s invalidity.
(b) This section does not authorize the commissioners court to limit or restrict the board from exercising the powers conferred on the board by law.
