(a) A local entity may not receive state grant funds, and state grant funds for the local entity shall be denied, for the state fiscal year following the year in which a final judicial determination in an action brought under § 364.003 is made that the entity has intentionally violated § 364.002.
(b) The comptroller shall adopt rules to implement this section uniformly among the state agencies from which state grant funds are distributed to a municipality or county.

Terms Used In Texas Local Government Code 364.004

  • Comptroller: means the state comptroller of public accounts. See Texas Government Code 312.011
  • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
  • Municipality: means a general-law municipality, home-rule municipality, or special-law municipality. See Texas Local Government Code 1.005
  • Year: means 12 consecutive months. See Texas Government Code 311.005

(c) A local entity that has not violated § 364.002 may not be denied state grant funds, regardless of whether the entity is a part of another entity that is in violation of that section.
