(a) The municipality, by resolution or an instrument authorized by a resolution, may convey property to an authority for use in a project.
(b) The legal title to real property conveyed remains with the municipality, but the authority may, until it ceases to exist, use the property.

  • Municipality: means a general-law municipality, home-rule municipality, or special-law municipality. See Texas Local Government Code 1.005
  • Personal property: All property that is not real property.
  • Property: means real and personal property. See Texas Government Code 311.005
  • Real property: Land, and all immovable fixtures erected on, growing on, or affixed to the land.

(c) Legal title to personal property conveyed passes to the authority.
