Under the Texas Codes, punishments for crimes depend on the classification. In the case of this section:

Terms Used In Texas Natural Resources Code 201.014

  • Person: includes corporation, organization, government or governmental subdivision or agency, business trust, estate, trust, partnership, association, and any other legal entity. See Texas Government Code 311.005

A person who violates Section 201.011 is guilty of a Class A misdemeanor, unless the person has previously been convicted of violating that section, in which case the person is guilty of a state jail felony.
