Terms Used In Texas Occupations Code 160.054
- Board: means the Texas Medical Board. See Texas Occupations Code 151.002
- Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
- Physician: means a person licensed to practice medicine in this state. See Texas Occupations Code 151.002
- Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
In the trial of an action against a physician based on the physician’s conduct in providing or failing to provide a medical or health care service, a report or other information submitted to the board under this subchapter and the fact that the report or information has been submitted to the board may not be offered in evidence or used in any manner.
