(a) If the secretary of state determines that a person regulated under this chapter has violated this chapter or a rule adopted under this chapter in a manner that constitutes a ground for disciplinary action under Section 2051.405, the secretary may assess an administrative penalty against the person as provided by this subchapter.
(b) The secretary shall determine the amount of a penalty assessed under Subsection (a), except that the amount may not exceed:
(1) $50,000 for a violation of Section 2051.351(a)(7) or (14); or
(2) $25,000 for any other violation.

- Person: includes corporation, organization, government or governmental subdivision or agency, business trust, estate, trust, partnership, association, and any other legal entity. See Texas Government Code 311.005
- Rule: includes regulation. See Texas Government Code 311.005
(c) In determining the amount of a penalty under Subsection (b), the secretary shall consider the seriousness of the violation.
