(a) No person may catch, take, or attempt to catch or take any aquatic animal life by any means or method from any privately owned waters without the consent of the landowner or the landowner’s agent.
(b) In a prosecution under this section, the burden of proof to show consent is on the person charged.
Terms Used In Texas Parks and Wildlife Code 66.002
- Catch: means take or kill and includes an attempt to take or kill. See Texas Parks and Wildlife Code 1.101
- Person: includes corporation, organization, government or governmental subdivision or agency, business trust, estate, trust, partnership, association, and any other legal entity. See Texas Government Code 311.005
- Take: except as otherwise provided by this code, means collect, hook, hunt, net, shoot, or snare, by any means or device, and includes an attempt to take or to pursue in order to take. See Texas Parks and Wildlife Code 1.101
