(a) For purposes of this section, “final conviction” includes a plea of guilty or nolo contendere to or the imposition of deferred adjudication or deferred disposition for an offense.
(b) A person who violates § 75.0104(a) or 75.0106 or a rule adopted under this chapter commits an offense that is a Class B Parks and Wildlife Code misdemeanor.

Terms Used In Texas Parks and Wildlife Code 75.0107

  • Nolo contendere: No contest-has the same effect as a plea of guilty, as far as the criminal sentence is concerned, but may not be considered as an admission of guilt for any other purpose.
  • Person: includes corporation, organization, government or governmental subdivision or agency, business trust, estate, trust, partnership, association, and any other legal entity. See Texas Government Code 311.005
  • Plea: In a criminal case, the defendant's statement pleading "guilty" or "not guilty" in answer to the charges, a declaration made in open court.

(c) If conduct constituting an offense under this section also constitutes an offense under § 33.112, Natural Resources Code, the actor may be prosecuted under this section, § 33.112, Natural Resources Code, or both.
