(a) A complainant, a respondent, or an aggrieved person on whose behalf a complaint was filed may elect to have the claims asserted in the charge decided in a civil action as provided by § 301.131.
(b) The election must be made not later than the 20th day after the date the person having the election receives service under § 301.089(b) or, in the case of the commission, not later than the 20th day after the date the charge is issued.

  • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
  • Person: includes corporation, organization, government or governmental subdivision or agency, business trust, estate, trust, partnership, association, and any other legal entity. See Texas Government Code 311.005

(c) The person making the election shall give notice to the commission and to all other complainants and respondents to whom the charge relates.
