Terms Used In Texas Property Code 92.260

  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
  • Month: means a calendar month. See Texas Government Code 312.011

A tenant of a landlord who is liable under § 92.259 may obtain or exercise one or more of the following remedies:
(1) a court order directing the landlord to comply with the tenant’s request if the tenant is in possession of the dwelling unit;
(2) a judgment against the landlord for damages suffered by the tenant because of the landlord’s violation;
(3) a judgment against the landlord for a civil penalty of one month‘s rent plus $100 if the landlord violates § 92.259(a)(2);
(4) a judgment against the landlord for court costs;
(5) a judgment against the landlord for attorney’s fees in an action under Subdivision (1) or (3); and
(6) unilateral termination of the lease without a court proceeding if the landlord violates § 92.259(a)(2).
