(a) A vacancy on the board shall be filled by appointment by the governor with the advice and consent of the senate.
(b) A person appointed to a vacant position serves for the unexpired part of the term.

- Advice and consent: Under the Constitution, presidential nominations for executive and judicial posts take effect only when confirmed by the Senate, and international treaties become effective only when the Senate approves them by a two-thirds vote.
- Person: includes corporation, organization, government or governmental subdivision or agency, business trust, estate, trust, partnership, association, and any other legal entity. See Texas Government Code 311.005
