(a) A contract awarded under this subchapter must:
(1) be in the name of the state;
(2) be signed by the director or a person the director designates; and
(3) have attached a copy of the certification required by § 223.103.
(b) A person designated under Subsection (a) may not occupy a position below the level of district engineer.
Terms Used In Texas Transportation Code 223.104
- Contract: A legal written agreement that becomes binding when signed.
- Person: includes corporation, organization, government or governmental subdivision or agency, business trust, estate, trust, partnership, association, and any other legal entity. See Texas Government Code 311.005
- Signed: includes any symbol executed or adopted by a person with present intention to authenticate a writing. See Texas Government Code 311.005
