(a) Except for the authority granted to a port-of-entry supervisor or inspector by § 621.409, weight enforcement officers have exclusive authority to enforce this subchapter in any area of this state, including all ports of entry between Texas and the United Mexican States.
(b) If a noncommissioned employee weighs a vehicle under § 621.402 and determines that an enforcement action, such as the issuance of a citation, is warranted, the employee may take enforcement action only if the employee is under the supervision of an officer of the Department of Public Safety.
