(a) The department may investigate and impose an administrative penalty on a shipper who:
(1) does not provide a shipper’s certificate of weight required under § 623.274(b); or
(2) provides false information on a shipper’s certificate of weight that the shipper delivers to a person transporting a shipment.
(b) The notice and hearing requirements of § 643.2525 apply to the imposition of an administrative penalty under this section as if the action were being taken under that section.

- Person: includes corporation, organization, government or governmental subdivision or agency, business trust, estate, trust, partnership, association, and any other legal entity. See Texas Government Code 311.005
(c) The amount of an administrative penalty imposed under this section is calculated in the same manner as the amount of an administrative penalty imposed under § 643.251.
