(a) A gas utility, including a business described by § 121.001(a)(3), is affected with a public interest.
(b) A business described by § 121.001(a)(3) is a virtual monopoly.
Terms Used In Texas Utilities Code 121.051
- Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
- Property: means real and personal property. See Texas Government Code 311.005
(c) A business described by § 121.001(a)(3) and the property of the business used in this state is subject to the jurisdiction, control, and regulation of the railroad commission as provided by this chapter.
