(a) The commission shall provide notice of a hearing under § 26.024 of this code by publishing the notice in the Texas Register.
(b) In addition to the requirements of Subsection (a) of this section, the commission shall also provide notice to each of the following that the commission believes may be affected:
(1) each local government whose boundary is contiguous to the water in question or whose boundaries contain all or part of the water, or through whose boundaries the water flows; and
(2) the holders of permits from the commission to discharge waste into or adjacent to the water in question.

  • Commission: means the Texas Natural Resource Conservation Commission. See Texas Water Code 26.001
  • Local government: means an incorporated city, a county, a river authority, or a water district or authority acting under Article III, § 52, or Article XVI, § 59 of the Texas Constitution. See Texas Water Code 26.001
  • To discharge: includes to deposit, conduct, drain, emit, throw, run, allow to seep, or otherwise release or dispose of, or to allow, permit, or suffer any of these acts or omissions. See Texas Water Code 26.001
