(a) The agency shall provide to the person filing the complaint about a matter within the commission’s regulatory jurisdiction and to each person who is the subject of the complaint a copy of the commission’s policies and procedures relating to complaint investigation and resolution.
(b) The commission, at least quarterly until final disposition of the complaint, shall notify the person filing the complaint and each person who is a subject of the complaint of the status of the investigation unless the notice would jeopardize an undercover investigation.

Terms Used In Texas Water Code 5.177

  • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Person: includes corporation, organization, government or governmental subdivision or agency, business trust, estate, trust, partnership, association, and any other legal entity. See Texas Government Code 311.005

(c) The commission is not required to provide the information described in Subsection (a) or (b) to a complainant who:
(1) files an anonymous complaint;
(2) provides inaccurate contact information; or
(3) files a complaint described by § 5.176(c).
