No person shall distribute an adulterated fertilizer product. A fertilizer shall be deemed to be adulterated if:

(1) It contains any deleterious or harmful ingredient in sufficient amount to render it injurious to beneficial plant life when applied in accordance with directions for use on the label, or if adequate warning statements or directions for use that may be necessary to protect plant life are not shown upon the label;

Terms Used In Tennessee Code 43-11-124

  • Label: means the display of all written, printed, or graphic matter upon the immediate container, or a statement accompanying a fertilizer. See Tennessee Code 43-11-103
  • Labeling: means all written, printed, or graphic matter upon or accompanying any fertilizer, or advertisements, brochures, posters, television, and radio announcements used in promoting the sale of such fertilizer. See Tennessee Code 43-11-103
  • Person: includes an individual, partnership, association, firm, and corporation. See Tennessee Code 43-11-103
(2) Its composition falls below or differs from what it is purported to possess by its labeling; or
(3) It contains unwanted crop seed or weed seed.
