Terms Used In Tennessee Code 55-4-331

  • Discovery: Lawyers' examination, before trial, of facts and documents in possession of the opponents to help the lawyers prepare for trial.
  • Owner: means a person who holds the legal title of a vehicle, or in the event a vehicle is the subject of an agreement for the conditional sale or lease thereof, with the right of purchase upon performance of the conditions stated in the agreement and with an immediate right of possession vested in the conditional vendee or lessee, or in the event a mortgagor of a vehicle is entitled to possession, then the conditional vendee or lessee or mortgagor shall be deemed the owner for the purpose of this chapter and chapter 10, parts 1-5 of this title. See Tennessee Code 55-8-101
  • Representative: when applied to those who represent a decedent, includes executors and administrators, unless the context implies heirs and distributees. See Tennessee Code 1-3-105
  • State: when applied to the different parts of the United States, includes the District of Columbia and the several territories of the United States. See Tennessee Code 1-3-105
  • Vehicle: means every device in, upon or by which any person or property is or may be transported or drawn upon a highway, excepting devices used exclusively upon stationary rails or tracks. See Tennessee Code 55-8-101
(1) An owner or lessee of a motor vehicle who is a resident of this state, complying with state motor vehicle laws relating to registration and licensing of motor vehicles and paying the regular fee applicable to the motor vehicle and the fee provided for in § 55-4-204, shall be issued a Tennessee Titans new specialty earmarked license plate for a motor vehicle authorized by § 55-4-210(c).
(2) The new specialty earmarked plates provided for in this subsection (a) must bear the official colors and logo of the Tennessee Titans National Football League (NFL) team and include the language “TITANS” in an appropriate design. The design of the plates is subject to the approval of the Tennessee Titans and the NFL, and must additionally afford the trademark protection as the Tennessee Titans and the NFL require as otherwise permitted by law.
(3) In accordance with § 55-4-301, the funds produced from the sale of the Tennessee Titans new specialty earmarked license plates must be allocated to the Tennessee Titans Foundation to be distributed in equal shares to the following organizations within thirty (30) days of allocation in the name of the Tennessee Titans Foundation and the state of Tennessee from the sale of specialty license plates:

(A) Camp Discovery;
(B) Jason Foundation;
(C) Boy Scouts of Tennessee;
(D) Girl Scouts of Tennessee;
(E) Boys & Girls Clubs of Tennessee;
(F) St. Jude Children’s Research Hospital;
(G) Vanderbilt Children’s Hospital;
(H) Baptist Hospital Maternity/Birthing Center;
(I) Tennessee State University Scholarship Fund; and
(J) Fisk University Scholarship Fund.
(b)

(1) An owner or lessee of a motor vehicle who is a resident of this state, upon complying with state motor vehicle laws relating to registration and licensing of motor vehicles and paying the regular fee applicable to the motor vehicle and the fee provided for in § 55-4-204, shall be issued a Nashville Predators new specialty earmarked license plate for a motor vehicle authorized by § 55-4-210(c).
(2) The new specialty earmarked plates provided for in this subsection (b) must be designed in consultation with an executive of the Nashville Predators.
(3) The funds produced from the sale of Nashville Predators new specialty earmarked license plates must be allocated to the Nashville Predators Foundation, in accordance with § 55-4-301. The funds must be used exclusively in furtherance of the organization’s activities in this state.
(c)

(1) An owner or lessee of a motor vehicle who is a resident of this state, upon complying with state motor vehicle laws relating to registration and licensing of motor vehicles and paying the regular fee applicable to the motor vehicle and the fee provided in § 55-4-204, shall be issued a Memphis Grizzlies new specialty earmarked license plate for a motor vehicle authorized by § 55-4-210(c).
(2) The new specialty earmarked plates provided for in this subsection (c) must contain the logo or other appropriate design representative of the Memphis Grizzlies. The plates must be designed in consultation with the Memphis Grizzlies organization.
(3) The funds produced from the sale of Memphis Grizzlies new specialty earmarked license plates must be allocated to the Memphis Grizzlies Charitable Foundation, in accordance with § 55-4-301. The funds must be used by the Foundation exclusively for its educational and mentoring programs and initiatives in Tennessee.
(d)

(1) An owner or lessee of a motor vehicle who is a resident of this state, upon complying with state motor vehicle laws relating to registration and licensing of motor vehicles and paying the regular fee applicable to the motor vehicle and the fee provided for in § 55-4-204, shall be issued an Atlanta Braves new specialty earmarked license plate for a motor vehicle authorized by § 55-4-210(c).
(2) The new specialty earmarked plates provided for in this subsection (d) must be designed in consultation with a representative of Major League Baseball (MLB).
(3) The funds produced from the sale of Atlanta Braves new specialty earmarked license plates must be allocated to the Atlanta Braves Foundation in accordance with § 55-4-301. The funds must be used exclusively in this state to support the foundation’s philanthropic activities and charitable sponsorships.
(e)

(1) An owner or lessee of a motor vehicle who is a resident of this state, upon complying with state motor vehicle laws relating to registration and licensing of motor vehicles and paying the regular fee applicable to the motor vehicle and the fee provided for in § 55-4-204, shall be issued a Chattanooga Football Club new specialty earmarked license plate for a motor vehicle authorized by § 55-4-210(c).
(2) The new specialty earmarked plates provided for in this subsection (e) must contain an appropriate logo or design representative of Chattanooga Football Club. The plates must be designed in consultation with a representative from the Chattanooga FC Foundation.
(3) The funds produced from the sale of the Chattanooga Football Club new specialty earmarked license plates must be allocated to the Chattanooga FC Foundation, in accordance with § 55-4-301. The funds must be used exclusively in this state to enrich the lives of children and families in Chattanooga found in economically or culturally challenged neighborhoods, to build a strong community and healthy lifestyles through partnerships with local churches, schools, and recreation centers, and to support after-school and summer soccer programs that seek to develop creativity, discipline, social skills, and team building.
(f)

(1) An owner or lessee of a motor vehicle who is a resident of this state, upon complying with state motor vehicle laws relating to registration and licensing of motor vehicles and paying the regular fee applicable to the motor vehicle and the fee provided for in § 55-4-204, must be issued a Nashville SC new specialty earmarked license plate for a motor vehicle authorized by § 55-4-210(c).
(2) The new specialty earmarked license plates provided for in this subsection (f) must contain an appropriate logo or design representative of Nashville SC and be designed in consultation with a representative of Nashville Soccer Club LLC and the Nashville SC Community Fund, a component of the Community Foundation of Middle Tennessee.
(3) The funds produced from the sale of Nashville SC new specialty earmarked license plates must be allocated to the Nashville SC Community Fund, a component of the Community Foundation of Middle Tennessee in accordance with § 55-4-301. The funds must be used exclusively to support and enhance communities in this state served by Major League Soccer and Nashville SC.
(g)

(1) An owner or lessee of a motor vehicle who is a resident of this state, upon complying with state motor vehicle laws relating to registration and licensing of motor vehicles and paying the regular fee applicable to the motor vehicle and the fee provided for in § 55-4-204, must be issued a Bristol Motor Speedway new specialty earmarked license plate for a motor vehicle authorized by § 55-4-210(c).
(2) The new specialty earmarked license plates provided for in this subsection (g) must be designed in consultation with a representative of Bristol Motor Speedway and Speedway Children’s Charities.
(3) The funds produced from the sale of Bristol Motor Speedway new specialty earmarked license plates must be allocated to Speedway Children’s Charities, in accordance with § 55-4-301, to be used exclusively in the eight-county area of Northeast Tennessee in furtherance of the organization’s mission to support community and charitable programs and services directed toward the needs of children.
