Terms Used In Tennessee Code 66-11-103

  • Contract: A legal written agreement that becomes binding when signed.
  • Contract: means an agreement for improving real property, written or unwritten, express or implied, and includes extras as defined in this section. See Tennessee Code 66-11-101
  • Person: means an individual, corporation, limited liability company, partnership, limited partnership, sole proprietorship, joint venture, association, trust, estate, or other legal or commercial entity. See Tennessee Code 66-11-101
  • Prime contractor: means a person, including a land surveyor as defined in §. See Tennessee Code 66-11-101
  • Property: includes both personal and real property. See Tennessee Code 1-3-105
  • written: includes printing, typewriting, engraving, lithography, and any other mode of representing words and letters. See Tennessee Code 1-3-105

When the contract for improving real property is made with a husband or a wife who is not separated and living apart from that person‘s spouse, and the property is owned by the other spouse or by both spouses, the spouse who is the contracting party shall be deemed to be the agent of the other spouse unless the other spouse serves the prime contractor with written notice of that spouse’s objection to the contract within ten (10) days after learning of the contract.
