Review of a boundary commission decision may be sought in the district court with jurisdiction in the county in which the boundary commission is established by filing a petition for review of the decision within 20 days of the commission’s decision under Section 10-2-416. |
Terms Used In Utah Code 10-2-417
- Commission: means a boundary commission established under Section 10-2-409 for the county in which the property that is proposed for annexation is located. See Utah Code 10-2-401
- Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.

The district court review shall be on the record of the hearing under Section 10-2-415 and may not be de novo review. |

The district court shall affirm the commission’s decision unless the court determines that the decision is arbitrary or capricious. |
