Subject to Subsection 10-3-913(4), the chief of police or marshal in each city of the third, fourth, or fifth class or town:
(1) shall:

- City: means a municipality that is classified by population as a city of the first class, a city of the second class, a city of the third class, a city of the fourth class, or a city of the fifth class, under Section
10-2-301 . See Utah Code 10-1-104 - Person: means an individual, corporation, partnership, organization, association, trust, governmental agency, or any other legal entity. See Utah Code 10-1-104
- Town: means a municipality classified by population as a town under Section
10-2-301 . See Utah Code 10-1-104
(1)(a) exercise and perform the duties that are prescribed by the legislative body;
(1)(b) be under the direction, control, and supervision of the person or body that appointed the chief or marshal; and
(1)(c) adopt a written policy that prohibits the stopping, detention, or search of any person when the action is solely motivated by considerations of race, color, ethnicity, age, or gender; and
(2) may, with the consent of the person or body that appointed the chief or marshal, appoint assistants to the chief of police or marshal.
