Terms Used In Utah Code 11-17-16
- Bonds: means bonds, notes, or other evidences of indebtedness. See Utah Code 11-17-2
- Governing body: means :(5)(a) for a county, city, or town, the legislative body of the county, city, or town;(5)(b) for the Utah Inland Port Authority created in Section
11-58-201 , the board, as defined in Section11-58-102 ;(5)(c) for the military installation development authority created in Section63H-1-201 , the board, as defined in Section63H-1-102 ;(5)(d) for a state university except as provided in Subsection (5)(e), the board or body having the control and supervision of the state university; and(5)(e) for a nonprofit corporation or foundation created by and operating under the auspices of a state university, the board of directors or board of trustees of that corporation or foundation. See Utah Code 11-17-2- Industrial park: includes the development of the land for an industrial park under this chapter or the acquisition and provision of water, sewerage, drainage, street, road, sidewalk, curb, gutter, street lighting, electrical distribution, railroad, or docking facilities, or any combination of them, but only to the extent that these facilities are incidental to the use of the land as an industrial park. - Land: includes :
(18)(a) land;(18)(b) a tenement;(18)(c) a hereditament;(18)(d) a water right;(18)(e) a possessory right; and(18)(f) a claim. See Utah Code 68-3-12.5- Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
- Municipality: means any incorporated city or town in the state, including cities or towns operating under home rule charters. See Utah Code 11-17-2
- Person: means :
(24)(a) an individual;(24)(b) an association;(24)(c) an institution;(24)(d) a corporation;(24)(e) a company;(24)(f) a trust;(24)(g) a limited liability company;(24)(h) a partnership;(24)(i) a political subdivision;(24)(j) a government office, department, division, bureau, or other body of government; and(24)(k) any other organization or entity. See Utah Code 68-3-12.5- State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
- State university: means an institution of higher education as described in Section
53B-2-101 and includes any nonprofit corporation or foundation created by and operating under their authority. See Utah Code 11-17-2(1)(a) The governing body may provide for the publication of any resolution or other proceeding adopted by it under this chapter, including all resolutions providing for the sale or lease of any land by the municipality, county, or state university in connection with the establishment, acquisition, development, maintenance, and operation of an industrial park.(1)(b) The publication shall be given:(1)(b)(i) as a class A notice under Section 63G-30-102, for at least seven days:(1)(b)(i)(A) for the municipality or county; or(1)(b)(i)(B) in the case of a state university, for the county within which the principal administrative office of the state university is located; and(1)(b)(ii) as required in Section 45-1-101.(2) In case of a resolution or other proceeding providing for the issuance of bonds, the governing body may, in lieu of publishing the entire resolution or other proceeding, publish a notice of bonds to be issued, titled as such, containing:(2)(a) the name of the issuer;(2)(b) the purpose of the issue;(2)(c) the name of the users, if known;(2)(d) the maximum principal amount which may be issued;(2)(e) the maximum number of years over which the bonds may mature; and(2)(f) the times and place where a copy of the resolution or other proceeding may be examined, which shall be at an office of the issuer, identified in the notice, during regular business hours of the issuer as described in the notice and for a period of at least 30 days after the publication of the notice.(3) For a period of 30 days after publication any person in interest may contest the legality of the resolution, proceeding, any bonds which may be authorized under them, or any provisions made for the security and payment of the bonds. After expiration of the 30-day period no person may contest the regularity, formality, or legality of the resolution, proceedings, bonds, or security provisions for any cause.
