(1) There is established within the Department of Commerce the Division of Consumer Protection.
Terms Used In Utah Code 13-2-1 v2
- Fraud: Intentional deception resulting in injury to another.
- Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
- Person: means :(24)(a) an individual;(24)(b) an association;(24)(c) an institution;(24)(d) a corporation;(24)(e) a company;(24)(f) a trust;(24)(g) a limited liability company;(24)(h) a partnership;(24)(i) a political subdivision;(24)(j) a government office, department, division, bureau, or other body of government; and(24)(k) any other organization or entity. See Utah Code 68-3-12.5
- Process: means a writ or summons issued in the course of a judicial proceeding. See Utah Code 68-3-12.5
- Settlement: Parties to a lawsuit resolve their difference without having a trial. Settlements often involve the payment of compensation by one party in satisfaction of the other party's claims.
- State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
- Subpoena: A command to a witness to appear and give testimony.
(2) The division shall administer and enforce the following:(2)(a) Chapter 10a, Music Licensing Practices Act;(2)(b) Chapter 11, Utah Consumer Sales Practices Act;(2)(c) Chapter 15, Business Opportunity Disclosure Act;(2)(d) Chapter 20, New Motor Vehicle Warranties Act;(2)(e) Chapter 21, Credit Services Organizations Act;(2)(f) Chapter 22, Charitable Solicitations Act;(2)(g) Chapter 23, Health Spa Services Protection Act;(2)(h) Chapter 25a, Telephone and Facsimile Solicitation Act;(2)(i) Chapter 26, Telephone Fraud Prevention Act;(2)(j) Chapter 28, Prize Notices Regulation Act;(2)(k) Chapter 32a, Pawnshop, Secondhand Merchandise, and Catalytic Converter Transaction Information Act;(2)(l) Chapter 34, Utah Postsecondary School and State Authorization Act;(2)(m) Chapter 41, Price Controls During Emergencies Act;(2)(n) Chapter 42, Uniform Debt-Management Services Act;(2)(o) Chapter 49, Immigration Consultants Registration Act;(2)(p) Chapter 51, Transportation Network Company Registration Act;(2)(q) Chapter 52, Residential Solar Energy Disclosure Act;(2)(r) Chapter 53, Residential, Vocational and Life Skills Program Act;(2)(s) Chapter 54, Ticket Website Sales Act;(2)(t) Chapter 56, Ticket Transferability Act;(2)(u) Chapter 57, Maintenance Funding Practices Act;(2)(v) Chapter 61, Utah Consumer Privacy Act;(2)(w) Chapter 63, Utah Social Media Regulation Act;(2)(x) Chapter 64, Vehicle Value Protection Agreement Act;(2)(y) Chapter 65, Utah Commercial Email Act;(2)(z) Chapter 67, Online Dating Safety Act;(2)(aa) Chapter 68, Lawyer Referral Consultants Registration Act; and(2)(bb) Chapter 71, Utah Minor Protection in Social Media Act.(3) In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, the division may make rules to establish:(3)(a) a public list that identifies a person who:(3)(a)(i) violates a chapter described in Subsection (2);(3)(a)(ii) without proper legal justification, fails to comply with an order, subpoena, judgment, or other legal process issued by:(3)(a)(ii)(A) the division; or(3)(a)(ii)(B) a court of competent jurisdiction; or(3)(a)(iii) breaches a settlement agreement, stipulation, assurance of voluntary compliance, or similar instrument signed by the person and the division; and(3)(b) a process by which a person may be removed from the list the division establishes as described in Subsection (3)(a).
