(1) Upon referral from the division, the attorney general or any district or county attorney may:

Terms Used In Utah Code 13-49-403

  • Division: means the Division of Consumer Protection in the department. See Utah Code 13-49-102
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Person: means :
         (24)(a) an individual;
         (24)(b) an association;
         (24)(c) an institution;
         (24)(d) a corporation;
         (24)(e) a company;
         (24)(f) a trust;
         (24)(g) a limited liability company;
         (24)(h) a partnership;
         (24)(i) a political subdivision;
         (24)(j) a government office, department, division, bureau, or other body of government; and
         (24)(k) any other organization or entity. See Utah Code 68-3-12.5
  • Restitution: The court-ordered payment of money by the defendant to the victim for damages caused by the criminal action.
     (1)(a) bring an action for temporary or permanent injunctive or other relief in any court of competent jurisdiction for any violation of this part;
     (1)(b) bring an action in any court of competent jurisdiction for the collection of penalties authorized under Subsection 13-49-402(2); or
     (1)(c) bring an action under Subsection 13-49-402(4).
(2) A court may, upon entry of final judgment, award restitution when appropriate to any person suffering loss because of a violation of this part if proof of loss is submitted to the satisfaction of the court.
