As used in this section:

(1) “Division” means the Division of Consumer Protection in the Department of Commerce.

Terms Used In Utah Code 13-56-102

  • Person: means :
         (24)(a) an individual;
         (24)(b) an association;
         (24)(c) an institution;
         (24)(d) a corporation;
         (24)(e) a company;
         (24)(f) a trust;
         (24)(g) a limited liability company;
         (24)(h) a partnership;
         (24)(i) a political subdivision;
         (24)(j) a government office, department, division, bureau, or other body of government; and
         (24)(k) any other organization or entity. See Utah Code 68-3-12.5
  • State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
  • Venue: The geographical location in which a case is tried.
(2) “Event” means a single, specific occurrence of one of the following, that takes place at a venue:

     (2)(a) a concert;
     (2)(b) a game;
     (2)(c) a performance;
     (2)(d) a show; or
     (2)(e) an occasion similar to the occasions described in Subsections (2)(a) through (d).
(3) “Exempt entity” means:

     (3)(a) a Division I college postseason basketball tournament;
     (3)(b) a nonprofit organization that:

          (3)(b)(i) is exempt from federal income taxation under Section 501(c)(3), Internal Revenue Code;
          (3)(b)(ii) is domiciled in the state; and
          (3)(b)(iii) produces an annual international film festival in the state; or
     (3)(c) a public or private postsecondary institution that is located in the state.
(4) “Restricted ticket” means a ticket to an event that is subject to a restriction that prohibits the purchaser from reselling or otherwise transferring the ticket by any lawful method.
(5) “Transferrable ticket” means a ticket to an event that a person issues using a delivery method that enables the purchaser to lawfully resell the ticket independent of the person who issued the ticket or the person’s agent or operator.

     (6)(a) “Venue” means real property located in the state where one or more persons host a concert, game, performance, show, or similar occasion.
     (6)(b) “Venue” includes an arena, a stadium, a theater, a concert hall, an amphitheater, a fairground, a club, a convention center, a public assembly facility, or a mass gathering location.
(7) “Venue operator” means a person who operates a venue.
