(1) The annual salaries of the officers of all counties in the state shall be fixed by the respective county legislative bodies, subject to the requirements of this section.

Terms Used In Utah Code 17-16-14

  • Advice and consent: Under the Constitution, presidential nominations for executive and judicial posts take effect only when confirmed by the Senate, and international treaties become effective only when the Senate approves them by a two-thirds vote.
  • Contract: A legal written agreement that becomes binding when signed.
  • County legislative body: means :
         (8)(a) the county commission, in the county commission or expanded county commission form of government established under Title 17, Chapter 52a, Changing Forms of County Government;
         (8)(b) the county council, in the county executive-council optional form of government authorized by Section 17-52a-203; and
         (8)(c) the county council, in the council-manager optional form of government authorized by Section 17-52a-204. See Utah Code 68-3-12.5
  • Executive: when used to describe the powers, duties, or functions of a person or body elected as the county executive or a person appointed as the county manager or administrative officer, refers to:
         (2)(a) the power and duty to carry laws and ordinances into effect and secure their due observance; and
         (2)(b) those powers, duties, and functions that, under constitutional and statutory provisions and through long usage and accepted practice and custom at the federal and state level, have come to be regarded as belonging to the executive branch of government. See Utah Code 17-50-101
  • Legislative: when used to describe the powers, duties, or functions of a county commission or council, refers to:
         (3)(a) the power and duty to enact ordinances, levy taxes, and establish budgets; and
         (3)(b) those powers, duties, and functions that, under constitutional and statutory provisions and through long usage and accepted practice and custom at the federal and state level, have come to be regarded as belonging to the legislative branch of government. See Utah Code 17-50-101
  • State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5

     (2)(a) As used in this Subsection (2):

          (2)(a)(i) “Compensation” means:

               (2)(a)(i)(A) salary, including salary paid under a contract;
               (2)(a)(i)(B) a budgeted bonus or budgeted incentive pay;
               (2)(a)(i)(C) a vehicle allowance; and
               (2)(a)(i)(D) deferred salary.
          (2)(a)(ii) “Compensation increase” means an increase in any item of compensation listed in Subsection (2)(a)(i).
          (2)(a)(iii) “Executive county officer” means:

               (2)(a)(iii)(A) the county manager or chief administrative officer;
               (2)(a)(iii)(B) the assistant county manager or assistant county chief administrative officer;
               (2)(a)(iii)(C) an individual who is the head or chief of a county department or division;
               (2)(a)(iii)(D) an individual who is the chief assistant or deputy of an individual described in Subsection (2)(a)(iii)(C); or
               (2)(a)(iii)(E) in a county of the first class with a county executive-council form of government under Section 17-52a-203, an individual appointed by the county executive to a position requiring the advice and consent of the county legislative body, as provided by county ordinance.
     (2)(b) Before a county legislative body may adopt a final budget or a final amended budget that includes a compensation increase for an executive county officer, the county legislative body shall:

          (2)(b)(i) hold a public hearing on the compensation increase; and
          (2)(b)(ii) publish notice of the time, place, and purpose of the public hearing:

               (2)(b)(ii)(A) for at least seven days before the date of the public hearing; and
               (2)(b)(ii)(B) as a class A notice under Section 63G-30-102.
     (2)(c) A public hearing under Subsection (2)(b)(i):

          (2)(c)(i) shall be held separate from any other public hearing; and
          (2)(c)(ii) may be held the same day as another public hearing, including immediately before or after the other public hearing.
