(1) As used in this section, “single-family limit” means the number of individuals allowed to occupy each residential unit that is recognized by a land use authority in a zone permitting occupancy by a single family.
Terms Used In Utah Code 17-27a-505.5
- Land use authority: means :(35)(a) a person, board, commission, agency, or body, including the local legislative body, designated by the local legislative body to act upon a land use application; or(35)(b) if the local legislative body has not designated a person, board, commission, agency, or body, the local legislative body. See Utah Code 17-27a-103
- Mountainous planning district: means an area designated by a county legislative body in accordance with Section
17-27a-901 . See Utah Code 17-27a-103 - State: includes any department, division, or agency of the state. See Utah Code 17-27a-103
- Unincorporated: means the area outside of the incorporated area of a municipality. See Utah Code 17-27a-103
(2) A county may not adopt a single-family limit that is less than:
(2)(a) three, if the county has within its unincorporated area:
(2)(a)(i) a state university;
(2)(a)(ii) a private university with a student population of at least 20,000; or
(2)(a)(iii) a mountainous planning district; or
(2)(b) four, for each other county.
