Terms Used In Utah Code 17-33-8

  • Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
  • Council: means the career service council, a three-member appeals and personnel advisory board. See Utah Code 17-33-2
  • County executive: means :
         (7)(a) the county commission, in the county commission or expanded county commission form of government established under Title 17, Chapter 52a, Changing Forms of County Government;
         (7)(b) the county executive, in the county executive-council optional form of government authorized by Section 17-52a-203; or
         (7)(c) the county manager, in the council-manager optional form of government authorized by Section 17-52a-204. See Utah Code 68-3-12.5
  • County legislative body: means :
         (8)(a) the county commission, in the county commission or expanded county commission form of government established under Title 17, Chapter 52a, Changing Forms of County Government;
         (8)(b) the county council, in the county executive-council optional form of government authorized by Section 17-52a-203; and
         (8)(c) the county council, in the council-manager optional form of government authorized by Section 17-52a-204. See Utah Code 68-3-12.5
  • Director: means the director of personnel management. See Utah Code 17-33-2
  • Executive: when used to describe the powers, duties, or functions of a person or body elected as the county executive or a person appointed as the county manager or administrative officer, refers to:
         (2)(a) the power and duty to carry laws and ordinances into effect and secure their due observance; and
         (2)(b) those powers, duties, and functions that, under constitutional and statutory provisions and through long usage and accepted practice and custom at the federal and state level, have come to be regarded as belonging to the executive branch of government. See Utah Code 17-50-101
  • Legislative: when used to describe the powers, duties, or functions of a county commission or council, refers to:
         (3)(a) the power and duty to enact ordinances, levy taxes, and establish budgets; and
         (3)(b) those powers, duties, and functions that, under constitutional and statutory provisions and through long usage and accepted practice and custom at the federal and state level, have come to be regarded as belonging to the legislative branch of government. See Utah Code 17-50-101
  • Person: means :
         (24)(a) an individual;
         (24)(b) an association;
         (24)(c) an institution;
         (24)(d) a corporation;
         (24)(e) a company;
         (24)(f) a trust;
         (24)(g) a limited liability company;
         (24)(h) a partnership;
         (24)(i) a political subdivision;
         (24)(j) a government office, department, division, bureau, or other body of government; and
         (24)(k) any other organization or entity. See Utah Code 68-3-12.5
     (1)(a) is a permanent service to which this chapter applies; and
     (1)(b) comprises all tenured county positions in the public service, except:

          (1)(b)(i) subject to Subsection (2):

               (1)(b)(i)(A) the county executive, members of the county legislative body, and other elected officials; and
               (1)(b)(i)(B) each major department head charged directly by the county legislative body, or by a board appointed by the county legislative body, with the responsibility of assisting to formulate and carry out policy matters;
          (1)(b)(ii) one confidential secretary for each elected county officer and major department head, if a confidential secretary is assigned;
          (1)(b)(iii) an administrative assistant to the county executive, each member of the county legislative body, and each elected official, if an administrative assistant is assigned;
          (1)(b)(iv) each duly appointed chief deputy of any elected county officer who takes over and discharges the duties of the elected county officer in the absence or disability of the elected county officer;
          (1)(b)(v) subject to Subsection (3), a person who is:

               (1)(b)(v)(A) appointed by an elected county officer to be a division director, to administer division functions in furtherance of the performance of the elected officer’s professional duties;
               (1)(b)(v)(B) in a confidential relationship with the elected county officer; and
               (1)(b)(v)(C) not in a law enforcement rank position of captain or below;
          (1)(b)(vi) each person employed to make or conduct a temporary and special inquiry, investigation, or examination on behalf of the county legislative body or one of its committees;
          (1)(b)(vii) each noncareer employee:

               (1)(b)(vii)(A) compensated for the employee’s services on a seasonal or contractual basis; and
               (1)(b)(vii)(B) hired on emergency or seasonal appointment basis, as approved by the council; and
          (1)(b)(viii) each provisional employee, as defined by the county’s policies and procedures or its rules and regulations;
          (1)(b)(ix) each part-time employee, as defined by the county’s policies and procedures or its rules and regulations;
          (1)(b)(x) each employee appointed to perform:

               (1)(b)(x)(A) work that does not exceed three years in duration; or
               (1)(b)(x)(B) work with limited funding; and
          (1)(b)(xi) each position that, by its confidential or key policy-determining nature, cannot or should not be appropriately included in the career service.
(2) Before a position under Subsection (1)(b)(i) may be changed from its current status to exempt or tenured, the career service council shall, after giving due notice, hold a public hearing on the proposed change of status.
(3)

     (3)(a) Subsection (1)(b)(v) may not be construed to cause a person serving as a nonexempt employee on May 5, 2008 in a position described in that subsection to lose the nonexempt status.
     (3)(b) The elected county officer in a supervisory position over an employee described in Subsection (3)(a) shall work with the county’s office of personnel management to develop financial and other incentives to encourage a nonexempt employee to convert voluntarily to exempt status.
(4)

     (4)(a) Rules and regulations promulgated under this chapter shall list by job title and department, office or agency, each position designated as exempt under Subsection (1)(b)(xi).
     (4)(b) A change in exempt status of a position designated as being exempt under Subsection (1)(b)(xi) constitutes an amendment to the rules and regulations promulgated under this chapter.
