(1) An owner of property within the district or a person interested in a contract or proposed contract that is the subject of a validation petition may appear and answer or otherwise plead in response to the validation petition:

Terms Used In Utah Code 17B-1-1205

  • Answer: The formal written statement by a defendant responding to a civil complaint and setting forth the grounds for defense.
  • Contract: A legal written agreement that becomes binding when signed.
  • Person: means an individual, corporation, partnership, organization, association, trust, governmental agency, or other legal entity. See Utah Code 17B-1-102
  • Property: includes both real and personal property. See Utah Code 68-3-12.5
  • Validation petition: means a petition requesting a validation order. See Utah Code 17B-1-1201
  • Validation proceedings: means judicial proceedings occurring in district court pursuant to a validation petition. See Utah Code 17B-1-1201
     (1)(a) at any time before the hearing under Section 17B-1-1203; or
     (1)(b) within any additional period of time that the district court allows.
(2) If a person fails to appear and answer or otherwise plead in the time allowed under Subsection (1):

     (2)(a) the allegations of the validation petition shall be considered admitted by that person; and
     (2)(b) that person may not participate in the validation proceedings.
