Terms Used In Utah Code 17B-1-414
- Infrastructure financing district: means a special district that operates under and is subject to the provisions of this chapter and Chapter 2a, Part 13, Infrastructure Financing Districts. See Utah Code 17B-1-102
- Municipal: means of or relating to a municipality. See Utah Code 17B-1-102
- Property: includes both real and personal property. See Utah Code 68-3-12.5
- Special district: means a limited purpose local government entity, as described in Section
17B-1-103 , that operates under, is subject to, and has the powers described in:(31)(a) this chapter; or(31)(b)(31)(b)(i) this chapter; and(31)(b)(ii)(31)(b)(ii)(A) Chapter 2a, Part 1, Cemetery Maintenance District Act;(31)(b)(ii)(B) Chapter 2a, Part 2, Drainage District Act;(31)(b)(ii)(C) Chapter 2a, Part 3, Fire Protection District Act;(31)(b)(ii)(D) Chapter 2a, Part 4, Improvement District Act;(31)(b)(ii)(E) Chapter 2a, Part 5, Irrigation District Act;(31)(b)(ii)(F) Chapter 2a, Part 6, Metropolitan Water District Act;(31)(b)(ii)(G) Chapter 2a, Part 7, Mosquito Abatement District Act;(31)(b)(ii)(H) Chapter 2a, Part 8, Public Transit District Act;(31)(b)(ii)(I) Chapter 2a, Part 9, Service Area Act;(31)(b)(ii)(J) Chapter 2a, Part 10, Water Conservancy District Act;(31)(b)(ii)(K) Chapter 2a, Part 11, Municipal Services District Act; or(31)(b)(ii)(L) Chapter 2a, Part 13, Infrastructure Financing Districts. (1)(a) Subject to Subsection (1)(b), the special district board shall adopt a resolution approving the annexation of the area proposed to be annexed or rejecting the proposed annexation within 90 days after:(1)(a)(i) expiration of the protest period under Subsection17B-1-412 (2), if sufficient protests to require an election are not filed;(1)(a)(ii) for a petition that meets the requirements of Subsection17B-1-413 (1):(1)(a)(ii)(A) a public hearing under Section17B-1-409 is held, if the board chooses or is required to hold a public hearing under Subsection17B-1-413 (2)(a)(ii); or(1)(a)(ii)(B) expiration of the time for submitting a request for public hearing under Subsection17B-1-413 (2)(a)(ii)(B), if no request is submitted and the board chooses not to hold a public hearing; or(1)(a)(iii) for a proposed annexation to an infrastructure financing district, the board’s certification of the annexation petition under Section17B-1-405 .(1)(b) If the special district has entered into an agreement with the United States that requires the consent of the United States for an annexation of territory to the district, a resolution approving annexation under this part may not be adopted until the written consent of the United States is obtained and filed with the board of trustees.(2)(2)(a)(2)(a)(i) Within the time specified under Subsection (2)(a)(ii), the board shall file with the lieutenant governor:(2)(a)(i)(A) a copy of a notice of an impending boundary action, as defined in Section67-1a-6.5 , that meets the requirements of Subsection67-1a-6.5 (3) and, if applicable, Subsection (2)(b); and(2)(a)(i)(B) a copy of an approved final local entity plat, as defined in Section67-1a-6.5 .(2)(a)(ii) The board shall file the documents listed in Subsection (2)(a)(i) with the lieutenant governor:(2)(a)(ii)(A) within 30 days after adoption of a resolution under Subsection (1), Subsection17B-1-412 (3)(c)(i), or Section17B-1-415 ; and(2)(a)(ii)(B) as soon as practicable after receiving the notice under Subsection10-2-425 (3) of a municipal annexation that causes an automatic annexation to a special district under Section17B-1-416 .(2)(b) For an automatic annexation to a special district under Section17B-1-416 , the notice of an impending boundary action required under Subsection (2)(a) shall state that an area outside the boundaries of the special district is being automatically annexed to the special district under Section17B-1-416 because of a municipal annexation under Title 10, Chapter 2, Part 4, Annexation.(2)(c) Upon the lieutenant governor’s issuance of a certificate of annexation under Section67-1a-6.5 , the board shall:(2)(c)(i) if the annexed area is located within the boundary of a single county, submit to the recorder of that county:(2)(c)(i)(A) the original:(2)(c)(i)(A)(I) notice of an impending boundary action;(2)(c)(i)(A)(II) certificate of annexation; and(2)(c)(i)(A)(III) approved final local entity plat; and(2)(c)(i)(B) a certified copy of the annexation resolution; or(2)(c)(ii) if the annexed area is located within the boundaries of more than a single county:(2)(c)(ii)(A) submit to the recorder of one of those counties:(2)(c)(ii)(A)(I) the original of the documents listed in Subsections (2)(c)(i)(A)(I), (II), and (III); and(2)(c)(ii)(A)(II) a certified copy of the annexation resolution; and(2)(c)(ii)(B) submit to the recorder of each other county:(2)(c)(ii)(B)(I) a certified copy of the documents listed in Subsection (2)(c)(i)(A)(I), (II), and (III); and(2)(c)(ii)(B)(II) a certified copy of the annexation resolution.(3)(3)(a) As used in this Subsection (3), “fire district annexation” means an annexation under this part of an area located in a county of the first class to a special district:(3)(a)(i) created to provide fire protection, paramedic, and emergency services; and(3)(a)(ii) in the creation of which an election was not required because of Subsection17B-1-214 (3)(d).(3)(b) An annexation under this part is complete and becomes effective:(3)(b)(i)(3)(b)(i)(A) on July 1 for a fire district annexation, if the lieutenant governor issues the certificate of annexation under Section67-1a-6.5 from January 1 through June 30; or(3)(b)(i)(B) on January 1 for a fire district annexation, if the lieutenant governor issues the certificate of annexation under Section67-1a-6.5 from July 1 through December 31; or(3)(b)(ii) upon the lieutenant governor’s issuance of the certificate of annexation under Section67-1a-6.5 , for any other annexation.(3)(c)(3)(c)(i) The effective date of a special district annexation for purposes of assessing property within the annexed area is governed by Section59-2-305.5 .(3)(c)(ii) Until the documents listed in Subsection (2)(c) are recorded in the office of the recorder of each county in which the property is located, a special district may not:(3)(c)(ii)(A) levy or collect a property tax on property within the annexed area;(3)(c)(ii)(B) levy or collect an assessment on property within the annexed area; or(3)(c)(ii)(C) charge or collect a fee for service provided to property within the annexed area.(3)(c)(iii) Subsection (3)(c)(ii)(C):(3)(c)(iii)(A) may not be construed to limit a special district’s ability before annexation to charge and collect a fee for service provided to property that is outside the special district’s boundary; and(3)(c)(iii)(B) does not apply until 60 days after the effective date, under Subsection (3)(b), of the special district’s annexation, with respect to a fee that the special district was charging for service provided to property within the annexed area immediately before the area was annexed to the special district.
