In an eminent domain action under this part, the court may award:

(1) costs and reasonable attorney fees to the condemnee if the amount of the court or jury award for the property exceeds the amount offered by the agency;

Terms Used In Utah Code 17C-1-905

  • Person: means :
         (24)(a) an individual;
         (24)(b) an association;
         (24)(c) an institution;
         (24)(d) a corporation;
         (24)(e) a company;
         (24)(f) a trust;
         (24)(g) a limited liability company;
         (24)(h) a partnership;
         (24)(i) a political subdivision;
         (24)(j) a government office, department, division, bureau, or other body of government; and
         (24)(k) any other organization or entity. See Utah Code 68-3-12.5
  • Property: includes both real and personal property. See Utah Code 68-3-12.5
(2) a reasonable sum, as determined by the court or jury, as compensation for any costs or expenses relating to relocating:

     (2)(a) an owner who occupied the acquired property;
     (2)(b) a party conducting a business on the acquired property; or
     (2)(c) a person displaced from the property, as permitted by Title 57, Chapter 12, Utah Relocation Assistance Act; and
(3) an amount to compensate for any fixtures or personal property that is:

     (3)(a) owned by the owner of the acquired property or by a person conducting a business on the acquired property; and
     (3)(b) damaged as a result of the acquisition or relocation.
