(1) In addition to the procedure in Section 17D-3-302, a person may be nominated to be a candidate for appointment as a member of a board of supervisors of a conservation district by a petition filed with the department no later than the date set by the commission as the close of nominations.
Terms Used In Utah Code 17D-3-304
- Commission: means the Conservation Commission, created in Section 4-18-104. See Utah Code 17D-3-102
- Conservation district: means a limited purpose local government entity, as described in Section 17D-3-103, that operates under, is subject to, and has the powers set forth in this chapter. See Utah Code 17D-3-102
- Department: means the Department of Agriculture and Food, created in Section 4-2-102. See Utah Code 17D-3-102
- Person: means :(24)(a) an individual;(24)(b) an association;(24)(c) an institution;(24)(d) a corporation;(24)(e) a company;(24)(f) a trust;(24)(g) a limited liability company;(24)(h) a partnership;(24)(i) a political subdivision;(24)(j) a government office, department, division, bureau, or other body of government; and(24)(k) any other organization or entity. See Utah Code 68-3-12.5
- Signature: includes a name, mark, or sign written with the intent to authenticate an instrument or writing. See Utah Code 68-3-12.5
- State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
(2) A petition under Subsection (1) shall:(2)(a) state:(2)(a)(i) the candidate’s name;(2)(a)(ii) that the candidate is at least 18 years old; and(2)(a)(iii) that the candidate for appointment is a resident of the conservation district for which the nomination for candidacy is to be held; and(2)(b) contain the notarized signature of the candidate.
