(1) If the executive director determines that an applicant has completed a voluntary cleanup in accordance with the agreement entered into under this chapter, the executive director shall within 30 days after the determination issue to the applicant a certificate of completion.
Terms Used In Utah Code 19-8-111
- Agreement: means a voluntary cleanup agreement under this chapter. See Utah Code 19-8-102
- Applicant: means the person:(3)(a) who submits an application to participate in a voluntary cleanup agreement under this chapter; or(3)(b) who enters into a voluntary cleanup agreement made under this chapter with the executive director. See Utah Code 19-8-102
- Completion: means , regarding property covered by an agreement:(4)(a) no further response actions are necessary; or(4)(b) the applicant is satisfactorily maintaining the engineering controls, remediation systems, postclosure care, and institutional controls to the extent required pursuant to the voluntary cleanup agreement. See Utah Code 19-8-102
- Executive director: means the executive director of the Utah Department of Environmental Quality or the executive director's representative. See Utah Code 19-8-102
- Property: includes both real and personal property. See Utah Code 68-3-12.5
- State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
(2) The certificate of completion shall:
(2)(a) acknowledge the protection from liability provided by Section 19-8-113;
(2)(b) state the proposed future use of the property as defined under the voluntary cleanup agreement;
(2)(c) provide a legal description of the property and identify the owner of the property; and
(3) The executive director shall upon issuance of the certificate of completion record a copy in the real property records of the county in which the site is located.
