(1) Each state office candidate and the candidate’s personal campaign committee is active and subject to interim reporting requirements until:
Terms Used In Utah Code 20A-11-205
- Candidate: means any person who:(4)(a) files a declaration of candidacy for a public office; or(4)(b) receives contributions, makes expenditures, or gives consent for any other person to receive contributions or make expenditures to bring about the person's nomination or election to a public office. See Utah Code 20A-11-101
- Convention: means the political party convention at which party officers and delegates are selected. See Utah Code 20A-1-102
- Person: means both natural and legal persons, including individuals, business organizations, personal campaign committees, party committees, political action committees, political issues committees, and labor organizations, as defined in Section
20A-11-1501 . See Utah Code 20A-11-101- Personal campaign committee: means the committee appointed by a candidate to act for the candidate as provided in this chapter. See Utah Code 20A-11-101
- Political party: means an organization of registered voters that has qualified to participate in an election by meeting the requirements of Chapter 8, Political Party Formation and Procedures. See Utah Code 20A-1-102
- State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
- State office: means the offices of governor, lieutenant governor, attorney general, state auditor, and state treasurer. See Utah Code 20A-11-101
- State office candidate: means a person who:
(58)(a) files a declaration of candidacy for a state office; or(58)(b) receives contributions, makes expenditures, or gives consent for any other person to receive contributions or make expenditures to bring about the person's nomination, election, or appointment to a state office. See Utah Code 20A-11-101- Summary report: means the year end report containing the summary of a reporting entity's contributions and expenditures. See Utah Code 20A-11-101
- Vacancy: means :
(75)(a) except as provided in Subsection (75)(b), the absence of an individual to serve in a position created by state constitution or state statute, whether that absence occurs because of death, disability, disqualification, resignation, or other cause ; or(75)(b) in relation to a candidate for a position created by state constitution or state statute, the removal of a candidate due to the candidate's death, resignation, or disqualification. See Utah Code 20A-1-102(1)(a) the candidate withdraws or is eliminated in a convention or primary; or(1)(b) if seeking appointment as a midterm vacancy state office candidate:(1)(b)(i) the political party liaison fails to forward the person‘s name to the governor; or(1)(b)(ii) the governor fails to appoint the person to fill the vacancy.(2) Each state office candidate and the candidate’s personal campaign committee is active and subject to year-end summary reporting requirements until the candidate has filed a statement of dissolution with the lieutenant governor stating that:(2)(a) the state office candidate or the personal campaign committee is no longer receiving contributions and is no longer making expenditures;(2)(b) the ending balance on the last summary report filed is zero and the balance in the separate bank account required in Section 20A-11-201 is zero; and(2)(c) a final summary report in the form required by Section 20A-11-203 showing a zero balance is attached to the statement of dissolution.(3) A statement of dissolution and a final summary report may be filed at any time.(4) Each state office candidate and the candidate’s personal campaign committee shall continue to file the year-end summary report required by Section 20A-11-203 until the statement of dissolution and final summary report required by this section are filed with the lieutenant governor.
