(1) The division shall invite persons who may have an interest in how the land in a wildlife management area is managed to participate in the management planning process.

Terms Used In Utah Code 23A-6-302

  • Division: means the Division of Wildlife Resources. See Utah Code 23A-1-101
  • Fishing: means to take fish or crayfish by any means. See Utah Code 23A-1-101
  • Hunting: means to take or pursue a reptile, amphibian, bird, or mammal by any means. See Utah Code 23A-1-101
  • Land: includes :
         (18)(a) land;
         (18)(b) a tenement;
         (18)(c) a hereditament;
         (18)(d) a water right;
         (18)(e) a possessory right; and
         (18)(f) a claim. See Utah Code 68-3-12.5
  • Management plan: means a document prepared in accordance with this chapter that describes how one or more tracts of land owned or managed by the division are to be used. See Utah Code 23A-6-101
  • Process: means a writ or summons issued in the course of a judicial proceeding. See Utah Code 68-3-12.5
  • Wildlife: means :
         (61)(a) crustaceans, including brine shrimp and crayfish;
         (61)(b) mollusks; and
         (61)(c) vertebrate animals living in nature, except feral animals. See Utah Code 23A-1-101
  • Wildlife management area: means :
         (3)(a) a single tract of land owned or managed by the division; or
         (3)(b) two or more tracts of land owned or managed by the division that are within close proximity of each other and managed as a single unit. See Utah Code 23A-6-101
(2) Those persons may include:

     (2)(a) persons who use, or may use, the land in a wildlife management area for:

          (2)(a)(i) agriculture, mining, or other commercial pursuits;
          (2)(a)(ii) hunting or fishing;
          (2)(a)(iii) recreation; or
          (2)(a)(iv) other uses;
     (2)(b) adjacent or nearby landowners or residents; or
     (2)(c) other interested parties.
(3) The division shall invite local government officials to participate in the management planning process.
(4) In preparing a management plan, the division shall seek to make land uses compatible with:

     (4)(a) local government general plans and zoning and land use ordinances; and
     (4)(b) existing rights of others within the wildlife management area.
(5)

     (5)(a) If the land in a wildlife management area is located within or adjacent to tribal lands, the division shall invite tribal government officials to participate in the management planning process.
     (5)(b) Participation by tribal officials in the development of management plans for lands owned by the division does not waive the tribe’s sovereignty.
