(1) The division shall provide cooperative wildlife management unit authorizations for hunting small game or waterfowl to the cooperative wildlife management unit, free of charge.

- Big game: means species of hoofed protected wildlife. See Utah Code 23A-1-101
- Certificate of registration: means a paper-based or electronic document issued under this title, or a rule or proclamation of the Wildlife Board granting authority to engage in activities not covered by a license, permit, or tag. See Utah Code 23A-1-101
- Cooperative wildlife management unit: means a generally contiguous area of land that is:(1)(a) open for hunting small game, waterfowl, turkey, or big game; and(1)(b) registered in accordance with this chapter and rules of the Wildlife Board. See Utah Code 23A-7-101
- Cooperative wildlife management unit permit: means a permit authorizing the possessor to hunt turkey, or big game in a cooperative wildlife management unit. See Utah Code 23A-7-101
- Division: means the Division of Wildlife Resources. See Utah Code 23A-1-101
- Game: means wildlife normally pursued, caught, or taken by sporting means for human use. See Utah Code 23A-1-101
- Hunting: means to take or pursue a reptile, amphibian, bird, or mammal by any means. See Utah Code 23A-1-101
- Land: includes :
(18)(a) land;(18)(b) a tenement;(18)(c) a hereditament;(18)(d) a water right;(18)(e) a possessory right; and(18)(f) a claim. See Utah Code 68-3-12.5- Landowner association: means a landowner or an organization of owners of private lands who operates a cooperative wildlife management unit. See Utah Code 23A-7-101
- Permit: means a paper-based or electronic document that grants authority to engage in specified activities under this title or a rule or proclamation of the Wildlife Board. See Utah Code 23A-1-101
- Small game: means species of protected wildlife:
(50)(a) commonly pursued for sporting purposes;(50)(b) not classified as big game, aquatic wildlife, or furbearers; and(50)(c) excluding turkey, cougar, and bear. See Utah Code 23A-1-101- State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
- Wildlife: means :
(61)(a) crustaceans, including brine shrimp and crayfish;(61)(b) mollusks; and(61)(c) vertebrate animals living in nature, except feral animals. See Utah Code 23A-1-101- Wildlife Board: means the board created in Section
23A-2-301 . See Utah Code 23A-1-101(2) At least 50% of the cooperative wildlife management unit authorizations for hunting small game or waterfowl provided to a cooperative wildlife management unit shall be offered for sale to the general public at the times and places designated on the application for a certificate of registration.(3)(3)(a) A cooperative wildlife management unit organized for hunting small game or waterfowl shall consist of private land.(3)(b) At least 75% of the acreage within the boundaries of a cooperative wildlife management unit organized for the hunting of small game or waterfowl shall be open to hunting by holders of valid authorizations.(4)(4)(a) The Wildlife Board may establish the maximum number of permits that may be issued per acre, except as provided in Subsection (4)(b).(4)(b) A cooperative wildlife management unit shall issue one buck deer permit or less per every 320 acres to be eligible to receive buck deer permits.(5)(5)(a) The division may issue cooperative wildlife management unit permits for hunting turkey or big game to permittees:(5)(a)(i) qualifying through a public drawing; or(5)(a)(ii) named by the cooperative wildlife management unit operator.(5)(b) The Wildlife Board may specify by rule, made in accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, those persons who are eligible to draw a cooperative wildlife management unit permit in a public drawing.(6)(6)(a) A cooperative wildlife management unit organized for hunting turkey or big game shall consist of private land to the extent practicable. Public land may be included within a cooperative wildlife management unit if:(6)(a)(i) the public land is completely surrounded by private land or is otherwise inaccessible to the general public;(6)(a)(ii) including public land is necessary to establish a readily identifiable boundary; or(6)(a)(iii) including public land is necessary to achieve turkey or big game management objectives.(6)(b) If public land is included within a cooperative wildlife management unit:(6)(b)(i) the landowner association shall meet applicable federal or state land use requirements on the public land; and(6)(b)(ii) the Wildlife Board shall increase the number of permits or hunting opportunities made available to the general public to reflect the proportion of public lands to private lands within the cooperative wildlife management unit.(7) A landowner association shall:(7)(a) clearly post the boundaries of the cooperative wildlife management unit by displaying signs containing information prescribed by rule of the Wildlife Board at the locations specified in Subsection 23A-5-317(1)(c); and(7)(b) provide a written copy of the landowner association’s guidelines to each holder of an authorization or permit.
