(1) As used in this section, “facility” means the same as that term is defined in Section 26B-2-236 .

- Committee: means the Health Facility Committee created in Section
26B-1-204 . See Utah Code 26B-2-201 - Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
- Resident: means a person 21 years old or older who:(19)(a) as a result of physical or mental limitations or age requires or requests services provided in an assisted living facility; and(19)(b) does not require intensive medical or nursing services as provided in a hospital or nursing care facility. See Utah Code 26B-2-201(2) In addition to the requirements in Section
26B-6-205 or80-2-602 , the department shall require a facility to report any incident of abuse, neglect, or exploitation of a resident:(2)(a) to the department; and(2)(b) to the Division of Child and Family Services or Adult Protective Services, if appropriate, or a law enforcement agency with jurisdiction over the covered provider in which the alleged incident occurred.(3) The department shall collect and compile all reported incidents described in Subsection (2)(a) and annually on or before June 30 report the data to the Health and Human Services Interim Committee.
