(1) The provisions of this part are:
Terms Used In Utah Code 26B-3-1112
- Common law: The legal system that originated in England and is now in use in the United States. It is based on judicial decisions rather than legislative action.
- Person: means an individual, corporation, unincorporated association, professional corporation, partnership, or other form of business association. See Utah Code 26B-3-1101
(1)(a) not exclusive, and the remedies provided for in this part are in addition to any other remedies provided for under:
(1)(a)(i) any other applicable law; or
(1)(a)(ii) common law; and
(1)(b) to be liberally construed and applied to:
(1)(b)(i) effectuate the chapter’s remedial and deterrent purposes; and
(1)(b)(ii) serve the public interest.
(2) If any provision of this part or the application of this part to any person or circumstance is held unconstitutional:
(2)(a) the remaining provisions of this part are not affected; and
(2)(b) the application of this part to other persons or circumstances are not affected.
