(1) The department shall make rules by following the procedures and requirements of Title 63G, Chapter 3, Utah Administrative Rulemaking Act.

Terms Used In Utah Code 26B-4-809

  • Emergency: means :
         (2)(a) a state of emergency declared by:
              (2)(a)(i) the president of the United States;
              (2)(a)(ii) the governor in accordance with Title 53, Chapter 2a, Part 2, Disaster Response and Recovery Act; and
              (2)(a)(iii) the chief executive officer of a political subdivision in accordance with Title 53, Chapter 2a, Part 2, Disaster Response and Recovery Act, for a local emergency; or
         (2)(b) a public health emergency declared by:
              (2)(b)(i) the executive director through a public health order in accordance with this title; or
              (2)(b)(ii) a local health department for a location under the local health department's jurisdiction. See Utah Code 26B-4-801
  • Entity: means a person other than an individual. See Utah Code 26B-4-801
(2) Before adopting rules under Subsection (1), the department shall consult and consider:

     (2)(a) the recommendations of the entity established to coordinate the implementation of the Emergency Management Assistance Compact; and
     (2)(b) rules adopted by similarly empowered agencies in other states in order to promote uniformity of application of this part and make the emergency response systems in the various states reasonably compatible.
