(1) The division shall administer the state hospital as part of the state‘s comprehensive mental health program and, to the fullest extent possible, shall, as the state hospital’s administrator, coordinate with local mental health authority programs.

Terms Used In Utah Code 26B-5-303

  • Administrator: includes "executor" when the subject matter justifies the use. See Utah Code 68-3-12.5
  • Director: means the director appointed under Section 26B-5-103. See Utah Code 26B-5-101
  • Division: means the Division of Integrated Healthcare created in Section 26B-1-1202. See Utah Code 26B-5-101
  • Executive director: means the executive director of the department appointed under Section 26B-1-203. See Utah Code 26B-1-102
  • Local mental health authority: means a county legislative body. See Utah Code 26B-5-101
  • Mental health facility: means the Utah State Hospital or other facility that provides mental health services under contract with the division, a local mental health authority, a person that contracts with a local mental health authority, or a person that provides acute inpatient psychiatric services to a patient. See Utah Code 26B-5-301
  • Patient: means an individual who is:
         (20)(a) under commitment to the custody or to the treatment services of a local mental health authority; or
         (20)(b) undergoing essential treatment and intervention. See Utah Code 26B-5-301
  • State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
  • State hospital: means the Utah State Hospital established in Section 26B-5-302. See Utah Code 26B-5-301
(2) The division has the same powers, duties, rights, and responsibilities as, and shall perform the same functions that by law are conferred or required to be discharged or performed by, the state hospital.
(3) Supervision and administration of security responsibilities for the state hospital is vested in the division. The executive director shall designate, as special function officers, individuals with peace officer authority to perform special security functions for the state hospital.
(4) A director of a mental health facility that houses an involuntary patient or a patient committed by judicial order may establish secure areas, as provided in Section 76-8-311.1, within the mental health facility for the patient.
