(1) The director, or the director’s designee may commit to the division an individual 18 years old or older who has an intellectual disability, for observation, diagnosis, care, and treatment if that commitment is based on:

Terms Used In Utah Code 26B-6-605

  • Director: means the director of the division. See Utah Code 26B-6-101
  • Division: means the Division of Aging and Adult Services within the department. See Utah Code 26B-6-101
  • Intellectual disability: means a significant, subaverage general intellectual functioning that:
         (16)(a) exists concurrently with deficits in adaptive behavior; and
         (16)(b) is manifested during the developmental period as defined in the current edition of the Diagnostic and Statistical Manual of Mental Disorders, published by the American Psychiatric Association. See Utah Code 68-3-12.5
  • State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
     (1)(a) involuntary commitment in accordance with Section 26B-6-608; or
     (1)(b) temporary emergency commitment in accordance with Section 26B-6-607.
(2) If an individual who is 18 years old or older is committed to the custody of the Utah State Developmental Center by the juvenile court, the director or the director’s designee shall give the juvenile court written notice of the intention to release the individual not fewer than five days before the day on which the individual is released.
