Terms Used In Utah Code 32B-4-504
- Affirmed: In the practice of the appellate courts, the decree or order is declared valid and will stand as rendered in the lower court.
- Commission: means the Alcoholic Beverage Services Commission created in Section
32B-2-201 . See Utah Code 32B-1-102 - Department: means the Department of Alcoholic Beverage Services created in Section
32B-2-203 . See Utah Code 32B-1-102 - Oath: A promise to tell the truth.
- Oath: includes "affirmation. See Utah Code 68-3-12.5
- Person: means :(24)(a) an individual;(24)(b) an association;(24)(c) an institution;(24)(d) a corporation;(24)(e) a company;(24)(f) a trust;(24)(g) a limited liability company;(24)(h) a partnership;(24)(i) a political subdivision;(24)(j) a government office, department, division, bureau, or other body of government; and(24)(k) any other organization or entity. See Utah Code 32B-1-102(1)(a) A person who makes a false material statement under oath or affirmation in an official proceeding before the commission or the department is guilty of a second degree felony.(1)(b) As used in Subsection (1)(a), “material” statement is as defined in Section 76-8-501.(2) A person is guilty of a class B misdemeanor if that person knowingly:(2)(a) makes a false statement under oath or affirmation in an official proceeding before the commission or the department;(2)(b) makes a false statement with a purpose to mislead a public servant in performing that public servant’s official functions under this title;(2)(c) makes a false statement and the statement is required by this title to be sworn or affirmed before a notary or other person authorized to administer oaths;(2)(d) makes a false written statement on or pursuant to a record required by this title;(2)(e) creates a false impression in a record required by this title by omitting information necessary to prevent a statement in them from being misleading;(2)(f) makes a false written statement with intent to deceive a public servant in the performance of that public servant’s official functions under this title; or(2)(g) submits or invites reliance on a record required under this title which that person knows to lack authenticity.(3) A person is not guilty under Subsection (2) if that person retracts the falsification before it becomes apparent that the falsification is or will be exposed. - Record: includes :
