(1) The department shall prepare and submit to the governor and the Legislature, by October 1 of each year, an annual written report of the operations, activities, programs, and services of the department, including its divisions, offices, boards, commissions, councils, and committees, for the preceding fiscal year.

Terms Used In Utah Code 35A-1-109

  • Department: means the Department of Workforce Services created in Section 35A-1-103. See Utah Code 35A-1-102
  • Executive director: means the executive director of the department appointed under Section 35A-1-201. See Utah Code 35A-1-102
  • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
  • State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
(2) For each operation, activity, program, or service provided by the department, the annual report shall include:

     (2)(a) a description of the operation, activity, program, or service;
     (2)(b) data and metrics:

          (2)(b)(i) selected and used by the department to measure progress, performance, effectiveness, and scope of the operation, activity, program, or service, including summary data; and
          (2)(b)(ii) that are consistent and comparable for each state operation, activity, program, or service that primarily involves employment training or placement as determined by the executive director, the commissioner of higher education, and the executive director of the Governor’s Office of Planning and Budget;
     (2)(c) budget data, including the amount and source of funding, expenses, and allocation of full-time employees for the operation, activity, program, or service;
     (2)(d) historical data from previous years for comparison with data reported under Subsections (2)(b) and (c);
     (2)(e) goals, challenges, and achievements related to the operation, activity, program, or service;
     (2)(f) relevant federal and state statutory references and requirements;
     (2)(g) contact information of officials knowledgeable and responsible for each operation, activity, program, or service; and
     (2)(h) other information determined by the department that:

          (2)(h)(i) may be needed, useful, or of historical significance; or
          (2)(h)(ii) promotes accountability and transparency for each operation, activity, program, or service with the public and elected officials.
(3) The annual report shall be designed to provide clear, accurate, and accessible information to the public, the governor, and the Legislature.
(4) The department shall:

     (4)(a) submit the annual report in accordance with Section 68-3-14;
     (4)(b) make the annual report, and previous annual reports, accessible to the public by placing a link to the reports on the department’s website; and
     (4)(c) provide the data and metrics described in Subsection (2)(b) to the Talent, Education, and Industry Alignment Board created in Section 53B-34-102.
