(1) At the discretion of the department, the department may pay the public assistance to the legal guardian of a recipient.
Terms Used In Utah Code 35A-3-109
- Cash assistance: means the monthly dollar amount a recipient is eligible to receive under the Family Employment Program under Section 35A-3-302. See Utah Code 35A-3-102
- Contract: A legal written agreement that becomes binding when signed.
- Department: means the Department of Workforce Services created in Section 35A-1-103. See Utah Code 35A-1-102
- Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
- Guardian: includes a person who:(14)(a) qualifies as a guardian of a minor or incapacitated person pursuant to testamentary or court appointment; or(14)(b) is appointed by a court to manage the estate of a minor or incapacitated person. See Utah Code 68-3-12.5
- Public assistance: means :
(10)(a) services or benefits provided under Chapter 3, Employment Support Act;(10)(b) medical assistance provided under Title 26B, Chapter 3, Health Care - Administration and Assistance;(10)(c) foster care maintenance payments provided from the General Fund or under Title IV-E of the Social Security Act;(10)(d) SNAP benefits; and(10)(e) any other public funds expended for the benefit of a person in need of financial, medical, food, housing, or related assistance. See Utah Code 35A-1-102- Recipient: means a person who is qualified to receive, is receiving, or has received assistance under this chapter. See Utah Code 35A-3-102
- State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
(2) The department may only provide cash assistance on behalf of an eligible recipient under Part 3, Family Employment Program, to another individual interested in or concerned with the welfare of the recipient if:(2)(a) by reason of the recipient’s physical or mental condition, the recipient is unable to manage funds;(2)(b) the provision of cash assistance directly to the recipient would be contrary to the recipient’s welfare; or(2)(c) the department is acting according to federal requirements.(3) The department shall:(3)(a) undertake or contract with other state agencies to make special efforts to protect the welfare of a recipient and improve the recipient’s capacity for self-care; and(3)(b) periodically review a recipient’s condition to determine whether, in the best interest of the recipient:(3)(b)(i) cash assistance that is provided to an individual other than the recipient should be discontinued; or(3)(b)(ii) a legal guardian should be appointed. - Public assistance: means :
