(1) This chapter does not apply to:

- Label: includes a representation on an invoice, bill, or letterhead. See Utah Code 4-16-102
- Sowing: means the placement of agricultural seed, vegetable seed, flower seed, tree and shrub seed, or seed for sprouting in a selected environment for the purpose of obtaining plant growth. See Utah Code 4-16-102
(1)(a) seed or grain not intended for sowing;
(1)(b) subject to Subsection (2), seed at, or consigned to, a seed processing or cleaning plant; or
(1)(c) to any carrier in respect to any seed transported or delivered for transportation in the ordinary course of its business as a carrier.
(2) Any label or other representation which is made with respect to seed described in Subsection (1)(b) that is made with respect to the uncleaned or unprocessed seed is subject to this chapter.
(3) A carrier described in Subsection (1)(c) may not be engaged in producing, processing, or marketing agricultural, vegetable, flower, or tree and shrub seeds or seeds for sprouting.
