Terms Used In Utah Code 4-17-108
- Commission: means the county legislative body of each county of this state. See Utah Code 4-17-102
- Department: means the Department of Agriculture and Food created in Chapter 2, Administration. See Utah Code 4-1-109
- Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
- Land: includes :(18)(a) land;(18)(b) a tenement;(18)(c) a hereditament;(18)(d) a water right;(18)(e) a possessory right; and(18)(f) a claim. See Utah Code 68-3-12.5
- Noxious weed: means any plant the commissioner determines to be especially injurious to public health, crops, livestock, land, or other property. See Utah Code 4-17-102
- Person: means a natural person or individual, corporation, organization, or other legal entity. See Utah Code 4-1-109
(1)(a) Each commission may employ one or more weed control supervisors qualified to:(1)(a)(i) detect and treat noxious weeds; and(1)(a)(ii) direct the weed control program for the county weed control board.(1)(b) A person may be a weed control supervisor for more than one county weed control board.(1)(c) Terms and conditions of employment shall be prescribed by the commission.
(2) A supervisor, under the direction of the local county weed control board, shall:
(2)(a) examine all land under the jurisdiction of the county weed control board to determine whether this chapter and the rules adopted by the department have been met;
(2)(b) compile data on infested areas;
(2)(c) consult and advise upon matters pertaining to the best and most practical method of noxious weed control and prevention;
(2)(d) render assistance and direction for the most effective control and prevention;
(2)(e) investigate violations of this chapter;
(2)(f) enforce noxious weed controls within the county; and
(2)(g) perform any other duties required by the county weed control board.
