Terms Used In Utah Code 4-31-119

  • Department: means the Department of Agriculture and Food created in Chapter 2, Administration. See Utah Code 4-1-109
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
     (1)(a) make rules, in accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, that are necessary for the control and prevention of disease in poultry, waterfowl, and game-birds; and
     (1)(b) enforce the rules described in Subsection (1)(a).
(2) The department may not make a rule under Subsection (1)(a) that relates to protected wildlife that is:

     (2)(a) living in nature; and
     (2)(b) under the jurisdiction of the Division of Wildlife Resources.
